Product Refunds and Exchanges

 

1. Product Return Policy

 

You may choose one of the following methods to return products purchased from Nu Skin Vietnam:

 

(a) Return under Vietnamese law

At your request, Nu Skin Vietnam will repurchase products you purchased from Nu Skin Vietnam, including those purchased under promotional programs, if the following conditions are met:
(i) The request to repurchase the product by the Brand Affiliate must be made within 30 (thirty) days from the date the Brand Affiliate received the product;
(ii) The returned product must remain intact with original packaging, labels, and seals at the time of return; and
(iii) The request must include the invoice for the products being returned.

 

(b) Return under Nu Skin Vietnam’s policy

In addition to the return rights under Vietnamese law, you may return products under Nu Skin Vietnam’s extended refund policy.
At the request of the Brand Affiliate, Nu Skin Vietnam will repurchase products if the following conditions are satisfied:
(i) The request to repurchase the product by the Brand Affiliate must be made within 12 (twelve) months from the date of order placement;
(ii) The returned product must remain intact with original packaging, labels, and seals at the time of return; and
(iii) The request must include the invoice for the products being returned.

In cases of returns that meet the conditions outlined above, Nu Skin Vietnam will refund at least 90% of the amount you paid for the returned products, after deducting administrative fees (if any) not exceeding 10% of the purchase price.

In compliance with Vietnamese law, Nu Skin Vietnam reserves the right to deduct bonuses already paid to you if you or your downlines return products under Nu Skin Vietnam’s return policy.
You may only return products that you purchased directly from the company. Nu Skin Vietnam will not reimburse you for the initial shipping costs incurred at the time of purchase. To ensure accurate deduction of bonuses corresponding to returned products, you must retain the order number on the invoice and provide it to the company at the time of the refund request. You may return individual products even if they were purchased as part of a set or package.

Refunds for repurchases upon termination of the Brand Affiliate Agreement will be processed via bank transfer or another mutually agreed-upon method if a bank transfer is not feasible, regardless of the initial payment method, unless otherwise required by law. For other cases, refunds will be issued as a company credit or another mutually agreed-upon method if a bank transfer is not feasible, unless otherwise required by law. The company credit may be used to purchase products.

Product returns may affect your bonuses and rank. If bonuses were paid for returned products, the company will deduct those bonuses as stipulated in Section 6.9 of Chapter 2 of this document.

Nu Skin Vietnam does not refund products purchased from other Brand Affiliates. You must request a refund directly from the Brand Affiliate who sold you the products.

 

2. Policy for Products Not Received

In accordance with policies published by the company from time to time, the company will exchange products purchased directly if they were delivered incorrectly or found defective, provided you notify the company within thirty (30) days of receipt. If an exchange cannot be processed, the company may provide:
(i) A credit equivalent to the value of the exchanged products, which can be used to purchase other products; or
(ii) A full refund of the purchase price.

 

3. Shipping Costs for Returns or Exchanges

To be eligible for refunds or exchanges, you must adhere to the following procedures:
(a) The company will provide you with the correct process and location for returning products. The company will not reimburse the original shipping costs (incurred at the time of purchase) for returned products. You must cover all return shipping costs unless the return is due to a company recall or under warranty policies applicable to the products; and
(b) Procedures may vary across different countries depending on local regulations.

 

4. Policy for Products Not Claimed

Under Vietnamese law, you agree that in the event:
(a) You fail to collect the products within 30 (thirty) days of payment to Nu Skin Vietnam; or
(b) You request delivery, and Nu Skin Vietnam agrees but cannot deliver the products to you within 30 (thirty) days of payment,

After the aforementioned period, Nu Skin Vietnam will cancel the paid order without prior consultation, notification, or explanation, and refund 100% of the amount you paid. Bonuses received (if any) from these canceled orders will be deducted in accordance with Section 6.9, Chapter 2 of the Operating Rules unless otherwise required by law.

 

5. Retail Sales and Product Returns by Customers

 

5.1 Retail Sales

Products purchased from the company may only be sold to retail customers, used for product demonstrations, or for personal use. You are authorized to sell products purchased from the company to retail customers. As per these terms, you may determine your retail prices and keep all profits from sales to your retail customers.

The company has established recommended retail prices for products based on competitive market prices. Maintaining retail prices for non-affiliates helps safeguard the product's value and the business opportunity.

 

5.2 No Wholesale Sales

You are prohibited from selling or distributing products to entities intending to resell them.

 

5.3 Retail Sales Receipts

You must provide two copies of Retail Sales Receipts to your customers, ensuring all details are complete, including a seven-day refund policy printed on the back.

 

5.4. Ensuring Refunds, Product Returns, and Exchanges for Your Retail Customers

 

(a) Refund Guarantee for Your Retail Customers:
You must provide your retail customers with a seven-day money-back guarantee. This means you are required, for any reason and upon request, to refund the full purchase price to the customer. The only condition is that the customer must request a refund within seven (7) business days from the date of purchase and return any unused portion of the product. You must refund the returned product within 10 days from the date of the customer's request. Nu Skin encourages you to fulfill your retail customers' requests for refunds or product exchanges even if the request is made after the seven-business-day period following the retail sale.

 

(b) When Retail Customers Purchase Products Directly from the Company:
Unless otherwise stipulated by law or under specific product guarantee policies, the Company will provide your retail customers with:
(i) A 100% refund for returned products if the products are returned within 30 days of receipt, regardless of whether the products have been used, are eligible for restocking, or can be resold; and
(ii) An exchange for products that were shipped incorrectly or are defective, as outlined in Section 4.2 of Chapter 2.

 

(c) When Retail Customers Purchase Products Directly from You:
If your retail customer purchased a product directly from you and returns it to you for a refund, you are responsible for providing the refund to the retail customer without any reimbursement from the Company. Nu Skin encourages you to fulfill your retail customers' requests for refunds even if the request is made after the seven-business-day period following your retail sale.

 

(d) When Retail Customers Request an Exchange for Products Purchased Directly from You:
If your retail customer purchased a product directly from you and wishes to exchange it, you are responsible for handling the exchange. The Company will only replace the exchanged product if the exchange request is made within 30 days from the date of your retail sale, and the product is defective.
