GIVEAWAY Rule and Terms and Conditions

1. In order to enter the GIVEAWAY (“Giveaway”), a participant must be 18 years old, live in the United States, follow @Nuskin on Instagram, “like” the giveaway post and comment why they would love to win during the contest period. Participants can receive an extra entry by following @nuskinus on TikTok.  No purchase is necessary.  One winner will be randomly selected and will receive a RenuSpa iO (the “prize”).  Nu Skin employees and their immediate family members are not eligible to win.

2. The winner will be notified on August 22, 2024.  The winner will receive a Direct Message on Instagram notifying them they have won and must respond within 1 day. If the winner does not respond within 1 day a new winner will be selected and the previous winner will forfeit the prize. Nu Skin is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or a participant’s failure to adequately monitor their Instagram account.

Any winner notification not responded to will result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively "the Prize Claim Documents"). No substitution or transfer of a prize is permitted except by Nu Skin. 

3. The prize is subject to availability.  Nu Skin reserves the right to modify the prize without prior notification.

4. Nu Skin reserves the right to withhold final approval of any and all prizes pending verification of compliance with the Giveaway rules, terms and conditions.  Nu Skin reserves the right, in its sole discretion, to suspend or discontinue the Giveaway if any participant misconduct or other such actions impair the integrity of the Giveaway, or if otherwise required by law.

5. This Giveaway will begin on August 19, 2024 and end on August 21, 2024 at 11:59 PM MDT. 

6. Nu Skin reserves the right to amend the terms and conditions of the Giveaway in its sole discretion. Nu Skin also reserves the right to interpret the rules of the Giveaway at its sole discretion and all company decisions shall be final.

7. Nu Skin reserves the right to disqualify and/or exclude from the Giveaway, in its sole and absolute discretion, any individual or affiliate for any reason or for no reason, including without limitation, violation of any portion of the official Rules and Terms and Conditions.

8. All Giveaway deadlines are subject to change without notice. 

9. The value of the prize may be considered taxable income to the Giveaway winners, and all taxes are the sole responsibility of the participants who receive the prizes. 

10. The Giveaway is void where prohibited by law and subject to all federal/state/local laws and regulations. Nu Skin reserves the right to substitute awards of equal or greater value.

11. The laws of the State of Utah shall govern the Giveaway, and participants in the Giveaway who are affiliates of Nu Skin hereby consent to the resolution of any disputes with regard to the Giveaway solely through the process described in the Mediation and Arbitration Policy noted in the Brand Affiliate Policies and Procedures. All such mediation and arbitration will be performed within the exclusive jurisdiction and venue of Utah. Each participant waives any and all objections to jurisdiction and venue and dispute resolution procedures. The Giveaway may only be participated in or from the United States and only by legal residents of those markets. Brand Affiliates and participants from any other jurisdiction or nonresidents of the jurisdictions listed above are not eligible. 

12. By participating, participants release and hold harmless Nu Skin Enterprises, Inc., its subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Giveaway or receipt or use of any awards. The prize recipient may not use the prize as income claims in promotion of the business opportunity.

13. Acceptance of any prize shall constitute and signify the prize recipients’ agreement and consent that their name, address, likeness, or other material submitted in connection with the Giveaway and/or prize information can be used for promotional purposes by Nu Skin Enterprises, Inc., or any of its subsidiaries or affiliates without further payment or consideration to the prize recipient.  Nu Skin shall have the right to copyright any materials provided under this Giveaway and to use the materials, in whole or in part, in any medium and for any purpose whatsoever.

14. This Giveaway is open to legal residents of the United States only.  Nu Skin Enterprises, Inc., and its respective parents, subsidiaries, affiliates, advertising and promotion agencies and each of their respective officers, directors and employees, are ineligible to enter the Giveaway or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. "Household Members" means those people who share the same residence at least three months a year. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Giveaway is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.

15.  Prizes, awards, are subject to the terms and conditions of the issuer. Prizes cannot be transferred, redeemed or returned for cash or substituted by the winners. Nu Skin reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Giveaway Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The Actual Retail Value (“ARV”) of the prize represents Nu Skin's good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash or products. Nu Skin makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. Nu Skin will not replace any lost or stolen prize items.

16.  This Giveaway is open to legal residents of United States and Prizes will only be awarded and/or delivered to addresses within the United States. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winners. Failure to comply with the Official Rules will result in forfeiture of the prize.

17. If participants choose to tag people, participants may only tag people they know.  Tagging random people will void the individual’s entry and that individual may be disqualified.

18.  The winner will be selected at random.  All decisions are final.  

19. Any personal information supplied by a participant will be subject to the privacy policy of the Nu Skin posted at www.nuskin.com. By entering the Giveaway, you grant Nu Skin permission to share your email address, Instagram account name, and any other personally identifiable information with the other Giveaway entrants for the purpose of administration and prize fulfillment, including use in a publicly available Winners list.

20. Nu Skin assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Giveaway; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Giveaway; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant's or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Giveaway.

If the Giveaway is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, Nu Skin reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaway in whole or in part. In such event, Nu Skin shall immediately suspend all entries and prize awards, and Nu Skin reserves the right to award any remaining prizes in a manner deemed fair and equitable by Nu Skin. Nu Skin and Released Parties shall not have any further liability to any participant in connection with the Giveaway.

This Giveaway is in no way sponsored, endorsed or administered by, or associated with, Instagram.  By participating, participants completely release and hold harmless Instagram, for any injuries, loss or damage of any kind arising from or in connection with the Giveaway or receipt or use of any awards.
