JUMPSTART SATURDAY PROMO! (THE “PROMOTION”)

Nu Skin Enterprises Philippines LLC (“Nu Skin Philippines”, “we” or “us”) is holding this Promotion during the following periods:

• Between 18 May 2023 (10:00 am) and 25 May 2023 (11:59 pm) for purchases made via Nu Skin Philippines’ website at www.nuskin.com.ph;
• Between 18 May 2023 (10:00 am) and 25 May 2023 (6:00 pm) for purchases made via nsorder@nuskin.com; and
• Between 18 May 2023 (10:00 am) and 25 May 2023 (7:00 pm) for over-the-counter purchases made via the Experience Centers (Ortigas and Cebu).

(Collectively, the “Promotion Period”)

These terms and conditions adopt the definitions and abbreviations found in the Nu Skin Brand Affiliate Agreement (Philippines), Nu Skin Policies & Procedures (Philippines) and the Nu Skin Sales Performance Plan (also known as “Velocity Sales Performance Plan”). Any undefined capitalized terms can be found in the aforementioned documents.

Your participation in this Promotion constitutes your acceptance of its terms and conditions. You may withdraw from this Promotion by notifying us in writing at any time.

Eligibility

1. To be eligible for this Promotion, you must be a Brand Affiliate with Nu Skin Philippines during the Promotion Period (“Eligible Brand Affiliate”, ”you” or “your”).

Promotion Mechanics

2. During the Promotion Period, you will be awarded with the following gift for meeting the various requirements as specified in the table below (the “Gifts”):

The Gifts are not cumulative and each Eligible Brand Affiliate is only entitled to a maximum of one (1) ageLOC LumiSpa Device and one (1) Jungamals for purchases of PHP25,000 and above in a single receipt.

3. During the Promotion Period, the following products will be offered for single invoice purchase at a discounted price (“Special Offer Products”):
   1. Glow Your Skin Package consisting of two (2) ageLOC Galvanic Face Gels and one (1) ageLOC LumiSpa Cleanser at PHP5,200 (usual Member Price PH5,755)
   2. I love Basic Package consisting of one (1) AP 24 Whitening Toothpaste, one (1) Scion Roll-On Deodorant 24hr Protection, one (1) Scion Roll-On Deodorant pH Balance, one (1) Epoch Baobab Body Butter and one (1) Epoch Polishing Bar at PHP2,100 (usual Member Price PHP2,375)
4.  The ageLOC ageLOC LumiSpa 1.0 Device shall be covered by Nu Skin’s standard warranty in relation to similar equipment (“Standard Warranty”).

General Terms and Conditions

5. By participating in this Promotion, you consent to Nu Skin Philippines’ collection, use and disclosure of your personal data with us, including your name, email address, and photographs, for the purposes of administering and promoting this Promotion. Such purposes include the advertising, marketing, and promotion of this Promotion to our Nu Skin Brand Affiliates and the distribution of the Gift(s). 
6. You also agree that: 
   1. You have read, understood and agreed to be bound by all the terms and conditions of this Promotion, Velocity, the Policies and Procedures, and the Brand Affiliate Agreement (including the International Sponsor Agreement and the Resident Market Product Purchase Agreement); 
   2. You must be in good standing as a Nu Skin Brand Affiliate to be able to participate in this Promotion; and 
   3. You are responsible to keep yourself updated of any changes, amendments or variations to the Promotion rules or these terms and conditions. 
7.  In respect of the Gift(s), you agree that: 
   1. The Gift(s) are non-exchangeable for any reason except for product defect;
   2. The Gift(s) is non-transferable and non-redeemable for cash;.  
   3. You are personally and solely responsible for any expenses or taxes incurred or which may be incidental to receiving and winning the Gift(s); 
   4. The Gift(s) does not carry Sales Volume, Personal Sales Volume and/or Commissionable Sales Volume and no such Sales Volume, Personal Sales Volume and/or Commissionable Sales Volume will be accorded to you upon your receipt of the Gift(s); and 
   5. The availability of the Gift(s) is only on a first come, first served basis and while stocks last. Nu Skin Philippines has the absolute discretion to replace, change or substitute the Gift(s) with other items of equivalent value without prior notice or reference to you. 
8. All requests for refund in relation to the purchases made under this Promotion are subject to Nu Skin’s Policies and Procedures. In the case of return of products purchased under this Promotion, the free Gift(s) must also be returned in an unopened and resaleable condition. Nu Skin shall use the discounted price under the Promotion as the price to calculate the refund amount. In the event that the Gift(s) have been used or you are otherwise unable to return the free Gift(s) in an unopened and resaleable condition, you agree that Nu Skin shall have the discretion to deduct the value of the free Gift(s) as specified below from the total amount to be refunded to you:
   1. ageLOC LumiSpa Device – PHP7,800
   2. Jungamals – PHP1,970
9. Unless otherwise stated, no vouchers, discounts, offers, other promotions, privileges, and promotion codes may be used in conjunction with this Promotion.
10. This Promotion is separate from the enJoy program. You may not redeem or earn enJoy points on any products purchased under this Promotion .
11. It shall be in Nu Skin Philippines’ absolute discretion and unfettered right to do all things it deems fit in respect of the Promotion, including but not limited to the determination and/or performance of the following: 
    1. Change, amend or vary the Promotion rules or the terms and conditions in any way which Nu Skin Philippines deems fit, without notice or reference to you; 
    2. Disqualifying you from taking part in the Promotion or forfeiting the Gift(s) for any reasons whatsoever; 
    3. Terminating or suspending this Promotion at Nu Skin Philippines’ sole and absolute discretion, without any prior notice or reference to you. Such termination or suspension shall not entitle you to any claim or compensation against Nu Skin Philippines or our related entities for any and all loss or damage suffered or incurred as a direct or indirect result of the act of termination or suspension. 
12. Nu Skin Philippines’ decisions on all matters relating to or in connection with this Promotion are final, conclusive, and binding, and Nu Skin Philippines is not bound to give any reasons for its determination in relation to any matters relating to or in connection with this Promotion. 
13. Save for the Standard Warranty and to the fullest extent of applicable law, Nu Skin Philippines shall not, in any way, be responsible for any injury, loss or damage suffered as a result of or in connection with the Promotion and/or the Gift(s) however arising, including but not limited to, fulfilment of the Gift(s), or any breakdown or malfunction of the Gift(s). 
14. The terms of this Promotion incorporate the relevant terms and conditions of your Brand Affiliate Agreement, the Policies and Procedures, and the Velocity Sales Performance Plan, and shall be construed in accordance with and to give effect to the spirit and intent of the same. Accordingly, any dispute in respect of this Promotion shall be resolved in accordance with Chapter 7 of the Policies and Procedures. 
15. Should any part of these Promotion terms and conditions be void or unenforceable for any reason, the void or unenforceable term and condition, or any part thereof, shall be severed and deleted. The rest of these rules or terms and conditions shall not be affected and shall continue in full force and effect as if the void or unenforceable term and condition, or any part thereof, had never been contained herein.
